Terms of Service & User Agreement

1. Acceptance of Terms

1.1. This Terms of Service agreement (hereinafter referred to as the "Agreement") governs the relationship between the User and the Developers / Administration of the Drills application available at https://drills.imaginal.dev (hereinafter referred to as the "Service" or "Administration").

1.2. By registering for an account or using any features of the Service, the User agrees to be bound by all terms of this Agreement and the Privacy Policy. If you do not agree to these terms, please do not use the Service.

2. Disclaimer of Warranties & "As Is" Provision

2.1. Use at Your Own Risk: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, the Administration and Developers disclaim all warranties, express or implied, including performance, uninterrupted operation, or error-free service.

2.2. Limitation of Liability: Under no circumstances shall the Developers or Administration be liable for any direct, indirect, incidental, consequential, or special damages, loss of data, service interruptions, software bugs, or equipment failure arising out of or in connection with the use of the Service.

2.3. The User agrees to use the Service without any financial, technical, or legal claims against the Developers and Administration.

3. Database Backups & 5-Day Data Recovery Policy

3.1. Developer Backup Commitment: The Developer undertakes reasonable technical efforts to maintain automated database backups and retain backup copies for a period of 5 (five) calendar days.

3.2. Restoration Requests: In the event of data loss or technical failure, the User has the right to submit a restoration request to the Administration within 5 (five) days of the incident by emailing bmo@imaginal.dev to attempt data recovery from available backup copies.

3.3. After 5 days have elapsed, older backup snapshots are overwritten or purged, and data restoration cannot be guaranteed or executed.

4. Administration Rights: Account Suspension and Content Removal

4.1. The Administration reserves the absolute right, at any time, without prior notice and without providing any reason, to:

• Suspend, restrict, or permanently terminate any User account;
• Remove, modify, or restrict access to any user-generated content (including words, translations, notes, and profiles);
• Refuse access to the Service to anyone at the Administration's sole discretion.

4.2. Users whose accounts or content are suspended or removed shall have no right to compensation or damages.

5. Intellectual Property Protection & Anti-Copying Restrictions

5.1. All rights to the Drills application, including source code, interface code, UI/UX designs, branding, logos, software architecture, features, and core learning concepts, are exclusively owned by the Developer and protected by international intellectual property and copyright laws.

5.2. Strict Prohibition: Users and third parties are strictly prohibited from:

• Copying, reproducing, distributing, or modifying the interface code or backend logic of the Service;
• Decompiling, reverse engineering, or attempting to extract the source code of the Service;
• Cloning or borrowing the design, user interface, features, or core concept/idea of Drills to build derivative or competing products without explicit written permission from the Developer.

5.3. Any unauthorized copying or infringement of these intellectual property rights will be prosecuted under applicable law.

6. Modifications to Terms & Contact Information

The Administration reserves the right to modify these Terms of Service at any time. Updated terms become effective immediately upon posting. The current version of this Agreement is always accessible at: https://drills.imaginal.dev/terms-of-service. Continued use of the Service constitutes acceptance of the revised terms.
